1. Scope
These General Terms and Conditions (GTC) apply to all deliveries by MUSCHE GmbH to consumers (Section 13 of the German Civil Code (BGB)).
A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to either their commercial or self-employed professional activity.

3. Offer and Conclusion of Contract
3.1 The presentation of products in the online store does not constitute a legally binding offer but rather an invitation to place an order. Errors excepted.
3.2 By clicking the “Buy” button in the final step of the ordering process, you are placing a binding order for the items contained in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

5. Right of Withdrawal
5.1 Withdrawal Policy for Physical Products
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you—other than the carrier—took possession of the goods.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us immediately and, in any case, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires. You are responsible for the direct costs of returning the goods.
You are liable for any loss in value of the goods only if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.
Note on the Absence of the Right of Withdrawal
The right of withdrawal does not apply to distance sales contracts—
- for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or specification by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs,
- for the delivery of audio or video recordings or computer software, files on storage media, in a sealed package, if the seal has been broken after delivery.

6. Prices and Shipping Costs
6.1 The prices listed on the product pages include the statutory value-added tax and other price components.
6.2 Shipping costs depend on the quantity of goods ordered and the shipping method and will be clearly communicated to you before you submit your binding order. You can find an overview on the Shipping page.
7. Delivery
7.1 Delivery based on the listed shipping rates is available only within Germany.
For international shipments, please inquire about shipping rates.
7.2 Information on delivery times can be found on the respective product page.
7.3 If an item is unavailable, has been lost, etc., we are entitled to be released from our contractual obligation to deliver. We undertake to inform you immediately of the unavailability and to refund any payments received without delay.
8. Payment
8.1 Payment may be made by bank transfer, PayPal, Sofortüberweisung, or credit card.
8.2 If you select “prepayment” as the payment method, we will provide you with our bank account information in the order confirmation and will ship the goods upon receipt of payment.
8.3 You are only entitled to set off amounts if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged by us in writing.
8.4 You may exercise a right of retention only to the extent that the claims arise from the same contractual relationship.

9. Retention of Title
The goods remain our property until full payment has been made.
10. Warranty
The warranty is governed by the statutory provisions of the Federal Republic of Germany.
11. Contract Language
The contract language is German.
12. Governing Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory international consumer protection law provides otherwise.
13. Miscellaneous
Should any individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
